KVKK Privacy Notice

1. Data Controller

Under Law No. 6698 on the Protection of Personal Data (Kişisel Verilerin Korunması Kanunu, “KVKK”), your personal data is processed by Çayyolu Architecture & Construction (Çayyolu Mimarlık ve İnşaat, the “Company”) as data controller, within the scope described below.

2. Personal Data Processed

When you contact us through the forms on our website or by phone, WhatsApp or email, the following data may be processed:

• Identity data: first name, surname
• Contact data: phone number, email address, province / district / neighbourhood, address of the property to be surveyed
• Request data: the service requested, type and approximate size of the space, budget range, preferred start date, convenient time for a call, information you share in your message, and photos and documents you send
• Transaction security data: date and time of form submission, IP address, browser information

3. Purposes of Processing Personal Data

Your personal data is processed for the following purposes:

• receiving and assessing your requests for site surveys, quotations and information, and getting back to you,
• scheduling and carrying out site survey appointments,
• preparing quotations, managing contract processes and performing the service,
• following up on your requests and complaints,
• running information security processes and preventing misuse of the site,
• fulfilling obligations arising from legislation and providing information to competent authorities.

4. Legal Grounds and Method of Collection

Your personal data is collected through the forms on our website, phone calls, WhatsApp, email and face-to-face meetings, partly by automated means in electronic form and partly by non-automated means.

This data is processed on the legal grounds set out in Article 5(2) of the KVKK: being directly related to the conclusion or performance of a contract (sub-paragraph c), being necessary for the data controller to fulfil its legal obligation (sub-paragraph ç) and the legitimate interest of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject (sub-paragraph f). Where none of these grounds applies, your explicit consent is obtained.

5. Transfer of Personal Data

To the extent necessary to achieve the purposes above and in accordance with Articles 8 and 9 of the KVKK, your personal data may be transferred to:

• the service providers from whom we obtain website hosting, email and technical infrastructure services,
• suppliers and business partners we work with to carry out the project (limited strictly to the information the work requires),
• our lawyers and advisers in the event of legal disputes,
• competent public authorities and institutions, upon request.

If you contact us via WhatsApp, your messages are transmitted through the infrastructure of that application’s service provider.

6. Retention Period

Your personal data is retained for as long as the purpose of processing requires and for the limitation and retention periods set out in the relevant legislation. Site survey and quotation requests that do not result in a contract are deleted, destroyed or anonymised after a reasonable period.

7. Your Rights under Article 11 of the KVKK

Under Article 11 of the KVKK, by applying to the data controller you have the right to:

• find out whether your personal data is being processed,
• request information about the processing if it has been processed,
• find out the purpose of processing and whether the data is being used in line with that purpose,
• know the third parties in Turkey or abroad to whom it has been transferred,
• request correction if it has been processed incompletely or inaccurately,
• request its deletion or destruction within the framework of the conditions in Article 7 of the KVKK,
• request that third parties to whom the data has been transferred be notified of any correction, deletion or destruction,
• object to an outcome to your detriment arising from analysis exclusively by automated systems,
• claim compensation for damage suffered as a result of unlawful processing.

8. How to Apply

You can submit requests concerning your rights in writing, together with information identifying you, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, to Konutkent Mah. Yörük Ali Efe Cad. No: 6/27, Çayyolu, Çankaya / Ankara, or send them by email to info@cayyolumimarlik.com. Your application will be concluded free of charge within thirty days at the latest, depending on the nature of the request; if the process involves an additional cost, the fee schedule set by the Personal Data Protection Board may apply.
